Product Descriptions
We make every effort to ensure that descriptions, photographs and information shown on our website are accurate.
Plants are living products and their size, colour, shape and appearance may vary according to season, weather conditions, stage of growth and cultivation practices. Images are provided as a guide only.
Minor variations between photographs, descriptions and the plants supplied shall not constitute a fault.
All products are offered subject to availability. If an item becomes unavailable after an order is placed, we will contact you to discuss a substitute, back-order or refund.
Prices
All prices shown on our website are in Pounds Sterling (£) include VAT.
We reserve the right to amend prices at any time. However, any price changes will not affect orders that have already been accepted.
Delivery charges, where applicable, will be shown during the checkout process before payment is completed.
Orders
When you place an order, you will receive an acknowledgement email confirming receipt of your order.
The acknowledgement email confirming receipt of your order does not constitute acceptance of your order. Acceptance occurs when the goods are dispatched to you and a dispatch confirmation is issued. At that point a contract is formed between you and Bali-Hai Mail Order Nursery.
We reserve the right to refuse or cancel orders where necessary, including where products are unavailable, pricing errors occur, or payment cannot be authorised.
We will retain a record of orders in accordance with our Privacy Policy and applicable legal requirements.
Payment
Payment must be made in full before goods are dispatched.
Payments are processed securely through our payment service providers. We do not store full payment card details on our website.
Delivery
We will make every reasonable effort to dispatch orders within the times stated on our website.
Delivery dates are estimates only and are not guaranteed.
We are not liable for delays caused by postal operators, couriers, weather conditions, industrial action or circumstances beyond our reasonable control.
Risk in the goods passes to you when the goods are delivered to the address specified in your order and come into your physical possession, or the possession of a person identified by you to take delivery.
Damaged or Incorrect Goods
Please inspect your order promptly upon arrival.
If goods arrive damaged, defective or incorrect, please notify us as soon as possible and preferably within 48 hours of delivery, providing photographs where appropriate.
Nothing in these Terms and Conditions affects your statutory rights under consumer protection legislation.
Returns and Cancellations
If you wish to cancel an order before it has been dispatched, please contact us as soon as possible.
Under the Consumer Contracts Regulations 2013, consumers normally have the right to cancel certain distance purchases within 14 days. However, this right does not apply to goods that are liable to deteriorate or expire rapidly, including many live plants and other perishable horticultural products.
Where cancellation rights do not apply, this will be due to the nature of the goods supplied.
This does not affect your rights under the Consumer Rights Act 2015. If goods are faulty, damaged, not as described, or otherwise fail to meet your statutory rights, please contact us and we will work with you to resolve the issue.

Plant Care
Plants require appropriate care after delivery.
We cannot accept responsibility for losses resulting from incorrect planting, unsuitable growing conditions, adverse weather, pests, disease, neglect or other factors beyond our control after delivery.
Intellectual Property
All content on this website, including text, photographs, graphics, logos and website design, is the property of Bali-Hai Mail Order Nursery unless otherwise stated.
No material may be copied, reproduced, distributed or used without prior written permission.

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
Subject to the foregoing, our liability arising from any order shall not exceed the purchase price paid for the goods concerned.
We shall not be liable for indirect or consequential losses arising from the use of our products.
Governing Law
These Terms and Conditions are governed by the laws of Northern Ireland.
Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
Changes to These Terms
We reserve the right to update these Terms and Conditions from time to time.
The version in force at the time an order is placed will apply to that order.
